To the extent allowed by law, claims must be brought only in an individual capacity and not as a plaintiff or class member in any purported class, representative, or consolidated proceeding.

Governing Law And Venue

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles. Venue for disputes shall lie in the state or federal courts located in Colorado, unless applicable law requires otherwise.

Time Limit To Bring Claims

To the extent permitted by law, any claim arising from use of this service must be filed within one year after the claim arose, or it is permanently barred.

Limitation Of Liability

To the maximum extent permitted by law, ELIO LLC and its operators are not liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising from use of this tool, including reliance on projections, interruption, or data loss.

Indemnification

You agree to indemnify and hold harmless ELIO LLC from claims, liabilities, and expenses arising from misuse of the service, violation of these Terms, or violation of applicable law.

Severability And Survival

If any provision is held unenforceable, remaining provisions remain in effect to the maximum extent allowed. Sections intended to survive termination (including disclaimers, limitations, indemnity, and dispute provisions) survive.

Changes

These terms may be updated periodically. Continued use after updates constitutes acceptance of the revised terms.
